In consideration of the Atlanta Geological Society (hereinafter referred to as the “AGS”), allowing the undersigned to voluntarily participate in a special event (listed below, hereinafter referred to as the “Activity”), I the undersigned on behalf of, himself/herself and his/her heirs, executors, administrators and assignees, hereby waive, release, relinquish, discharge and agree to indemnify, protect and save harmless the AGS, its officers, members, agents and any and all persons, firms, corporations or third parties whatsoever (hereafter referred to as the “Releasees”) from any and all claims, demands or cause of action for monetary of whatever kind of nature including, but not limited to, all loss or damage, or any claim or damage on account of injury to the undersigned or property, or resulting in death of the undersigned whether caused by the negligence of the Releasees or otherwise, resulting from the undersigned’s voluntary participation in or growing out of or in any way connected with this Activity.
The undersigned hereby acknowledges, accepts and assumes full responsibility for all risk of bodily injury, death, or property loss or damage due to the negligence of the Releasees or otherwise while voluntarily participating in the Activity.
The undersigned agrees that this Release and Waiver of Claim is intended to be as broad and inclusive as permitted by the laws of the State of Georgia and that if any portion of the Release and Waiver of Claim is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Additionally, the undersigned hereby voluntarily grants AGS the right to use and make any and all sound recordings, photographs, film or video likenesses of him/her to use for educational, marketing, publication and other lawful purposes. The undersigned hereby renounces any claim to any payments for or royalty from these recordings, photographs, or likenesses. The undersigned understands that AGS, its officers and members may use these photographs or likenesses for any lawful purpose. Further, the undersigned hereby releases and convenants not to sue AGS or any of their officers, members or agents from any and all claims, rights or causes of action of whatever kind or nature that the undersigned might have as a result of the use of these photographs or likenesses.
The undersigned hereby certifies that he/she is eighteen (18) years of age or older. If the undersigned is not eighteen (18) years of age, he/she must have this Release and Waiver of Claim signed by a parent or legal guardian. Further, the undersigned states that he/she has carefully read and voluntarily signs this Release and Waiver of Claim.
